Section 1 **General**
Auost website offers its users the technical possibility to use the Auost website to match with other users and communicate with them.

1.2 **Account Creation**
When you create an account on our platform, you agree to provide accurate and up-to-date information about yourself or your family. 

1.3. **Background Checks**
We take safety seriously. All au pairs and host families must undergo background checks to ensure a secure and trustworthy community.

The fulfilment of all agreements concluded via the Auost website also takes place exclusively between users.

Section 2 **Payment**
Our payment terms are simple - you pay for the services you use. We offer transparent pricing and secure payment options for your convenience.

Section 3 **Matching Services**
While we do our best to match users based on preferences and compatibility, we cannot guarantee a perfect match. 

Section 4 **Cancellation Policy**
If you need to cancel your account or services, just give us a heads-up. We'll work with you to find a solution that works for everyone.

Section 5 **Community Guidelines**
Respect, kindness, and open communication are key in our community. Any form of discrimination, harassment, or inappropriate behavior will not be tolerated.

Section 6  **Intellectual Property**
 The content on our platform, including but not limited to logos, designs, and text, are owned by Auost. Please don't use or reproduce them without our permission.

Section 7 **ersonal responsibility**
We would like to point out that Auost only provides the platform.  The users are solely responsible for the information that they post on their profiles or communicate with each other. However, if Auost finds illegal content or if Auost strongly suspects that Information displayed or communicate is illegal, such as infringing third-party intellectual property rights, Auost is entitled to remove this info and block user. 

Section 8 **User account**
To view profiles, you must first register and create a user account. Registration may be unlimited, natural and legal persons. Registration of persons under 18 years of age is not allowed. Registration is free of charge. It is carried out by opening a user account with the consent of, among other things, these General Terms and Conditions and the Privacy Policy. With the successful registration, a contract for the use of the Auost website is concluded between Auost and the user. Auost reserves the right to refuse to register. The data requested by Auost at the time of registration must be provided in full and correctly. Auost can only carry out a very limited check of the data of the users stored during the registration. Despite our security precautions, it is therefore not excluded that incorrect contact details have been stored for a user account. Registration with Auost under a false identity is not permitted and will result in exclusion from the platform.

**8.1 Usernames** 
You are free to choose your username. However, the username must not be illegal, in particular no rights of third parties and also did not violate good morals. We do not have to accept a username that violates this. In this respect, we also have the right to a retrospective suspension. Use of the name and content of "Auost" It is not permitted to use our name in a manner that may give the undue impression that you, your company or your website are sponsored by Auost or are in business contact with Auost.

**8.2 Passwords** 
Please do not use easy-to-guess passwords. Keep your password secure for your personal account and do not share it with anyone. Auost will never ask you to share your personal password with employees or third parties. 

**8.3 Updating user data**
Please update your user data if it changes. If we cannot reach you within two weeks if necessary, such as complaints about the your profile, behaviour or information that you conveyed, using the contact details you provide, we may suspend your account until further notice for security reasons.

Section 9 **Responnsibilty**
Auost  assumes no responsibility for the content of users profiles or info shared among users. Each user is responsible for ensuring that his profile and info shared do not violate laws, auost’s terms and conditions and codes of conduct or the rights of third parties. Auost shall be entitled to a temporary or permanent suspension in the event of a breach of these Rules, depending on the situation of the individual case.

Section 10 **Rating System**
With the help of the Auost rating system, users can evaluate each other. Auost has no influence on these reviews. In exceptional cases, Auost may delete any reviews submitted. Users are obliged to provide only truthful information in their ratings.

Auost assumes no liability for the accuracy of these reviews. Auost may delete or change reviews that have already been submitted at all times and in its sole discretion.

Any use of the rating system, which is not exclusively for the purpose of an honest and objective evaluation, is prohibited. In particular, it is prohibited to give incorrect reviews, make reviews of yourself or encourage third parties to do so, assessments to include circumstances unrelated to the execution of the underlying contract and reviews outside the Auost website.

 

Section 11 **Costs**
Registration with Auost is free of charge, no registration fee or similar is charged. 

**11.1 Plans**
Auost offers subcription plans with additional features. These are yearly plans that automatically terminate after period has ended.

**11.2. Payment**
Our payment terms are simple - you pay for the services you use. We offer transparent pricing and secure payment options for your convenience.

11.3 . **Payment Provider**:
We utilize Paypal gateway for payment processing.

Section 12 **Cancellation Policy**
Life happens, we get it. If you need to cancel your account or services, just give us a heads-up. We'll work with you to find a solution that works for everyone.

Section 13 **Availability and failure Maintenance work** 
**13.1 Maintenance**
Is usually carried out between 2 a.m. and 5 a.m. and is limited to the minimum required. If Auost systems are technically or not technically accessible via the Internet due to maintenance or other reasons for which Auost is responsible, Auost reserves the right, in its sole discretion, to modify or modify the duration of any ongoing articles appropriately. let down. Section 14 **Rights of third parties**
Please observe the legal protection of third-party rights, in particular to foreign images and texts, which you may not use for your ownprofiles. Plagarised profiles can be deleted by us without warning.

Section 15 **Good Behaviour** 
Users may not use mechanisms, software or other scripts that may interfere with the functioning of the Auost website, or take any action that results in an unreasonable or excessive burden on the Auost infrastructure to be able to. 

Section 16 **Penalties in the event of misconduct**
If a user violates legal regulations, rights of third parties, the Auost Terms and conditions or Auost Code of Conduct, we may take the following measures – taking into account the legitimate interests of the respective user – in accordance with at its sole discretion:

Warn user, temporarily or permanently block the member account and delete account. In the case of a  final suspension of the member account (profile) a termination of the user contract without notice is possible. In this case, re-registration or use of Auost under a different profile is not permitted. A definitive blocking or deletion of the profile is particularly possible if:

  • There is an abuse of the platform
  • The user provided incorrect information when registering
  • The functionality of the auction platform is damaged or impaired by the user
  • The user violates legal or contractual conduct obligations massively or repeatedly

The above rights exist with particular regard to the legitimate interests of the user, even if there is a suspicion on the basis of concrete indications that a user is against legal regulations, rights of third parties, against the Auost AGBs.

Section 17 **Blocking of the User** 
To the corresponding notification by rights holders, in particular trademark holders, we are entitled to a temporary blocking of precisely designated profiles, which we receive in writing or in text form as infringed rights. If an immediate inspection results in the undoubted lack of authorization of the blocking, the profile is reactivated. Otherwise, we are entitled to await a court or official decision. Insofar as we do not suffer a culpable breach of contractual obligations in this procedure, no claims of the user arise from a blocking that is not justified as a result.

Section 18 **Right of withdrawal**
All commercial providers must fulfil a number of legal information obligations towards users and, as a rule, refer to the statutory right of withdrawal or return in the case of distance contracts. In case of doubt, you should seek advice from your lawyer about their correct use and any further legal requirements for your offer.   

Section 19 **Termination**
Users may terminate this User Agreement at any time. A written notice to Auost or an e-mail to auost@auost.de is sufficient for the cancellation notice.

Section 20 **Privacy Policy**
Your privacy is important to us. We collect and use your personal information in accordance with our Privacy Policy.

20.1 **Personal Information**
When you use our platform, we may collect certain personal information such as your name, contact details, and preferences. Rest assured, we take data protection seriously.

20.2 **Data Usage**
The information we collect is used to provide you with personalized au pair matching, communication tools, and other services. We do not sell your data to third parties.

20.3. **Security Measures**
We implement industry-standard security measures to protect your information from unauthorized access, disclosure, alteration, or destruction.

20.4. **Cookies**: 
Like many websites, we use cookies to enhance your browsing experience and gather statistical data. You can choose to accept or decline cookies through your browser settings.

20.5. **Third-Party Links**: 
Our platform may contain links to third-party websites. We are not responsible for the privacy practices or content of these sites, so make sure to review their privacy policies.

20.6. **Data Retention**
We retain your personal information as long as necessary to provide our services to you and as required by law. You can request deletion of your account at any time.

20.7. **Updates and Communication**
We may send you updates, newsletters, or promotional messages related to our services. You can opt out of these communications at any time.

20.8. **Children's Privacy**
Our platform is not intended for anyone under the age of 18. If we become aware that we have collected personal information from a child, we will take steps to delete it.

Section 21 **Social Media**
Auost holds a giveaways among users and followers from time to time on Platform and social media. The giveaway will be held on the basis of the following conditions of participation. Auost is responsible for the organisation, processing as well as the provision of prizes or profit distribution. Give aways are not affiliated with any social media platform. Only persons over 18 years of age are eligible to participate in Germany. Entrants under the age of 18 may also be excluded from the competition after the draw. One Giveaway per household. Participation is free of charge. By participating in the giveawy, the user/follower accepts these Terms and Conditions.

The promotional period runs from will be displayed via platform and social media channel. To participate in the giveaway, follow instructions provided within the promotional period. The Auost Marketing Team will announce the winner at the end of the give away period.

In the Giveaway, the prize described on the page will be raffled off. Auost cannot be held responsible for any technical faults, in particular failures of the telephone network, the network, electronics or the computer. The winner of the prize will be notified within 48 hours. A cash payment, payment in tangible assets or exchange of winnings is not possible. The prizes are non-transferable. The winner accepts any necessary changes to the prize due to other factors beyond the control of the companies involved in the promotion. The decisions of Auost are final. Questions in this regard cannot be answered. Auost reserves the right to suspend the promotion in whole or temporarily if any difficulties arise that jeopardize the integrity of the Giveaway. Auost also reserves the right to change these terms and conditions without notice. Any obligation to pay damages by Auost and its organs, employees and vicarious agents arose or in connection with the competition, regardless of the legal basis for which by law is permissible, to the extent permitted by law, to cases of intent or gross negligence Limited. Section 22 **Amendment to the General Terms and Conditions**
Auost reserves the right to change these AGBs at any time. Changes will be communicated to the user. If a user does not object to the validity of the new AGBs within two weeks of notification, the amended AGB shall be deemed to have been accepted. 

Section 23 **Final Provisions**
All declarations submitted under the user agreement to be concluded with Auost must be made in writing or by e-mail. If any provision of these General Terms and Conditions is ineffective, the remaining provisions remain unaffected. The invalid provision shall be deemed to be replaced by one that comes closest economically to the meaning and purpose of the invalid provision in a legally effective manner. The same applies to possible regulatory gaps.
